There are many scenarios where the court will grant child custody to grandparents/relatives on a temporary or permanent basis:

  • Death or incarceration of the custodial parent
  • Abandonment of the child
  • CPS intervention for child abuse or neglect
  • Indefinite custody while the parent seeks addiction or mental health treatment
  • Formalized custody by grandparents who are already raising the child as the de facto parents

In many cases, grandparents step forward to avoid removal of the child by CPS and placement in foster care.
